At Ping Identity we understand that while your privacy may be important to us, it is even more important to you, which we assume is why you are here reading this. First off, we want to welcome you to our site, and we appreciate you taking the time to read this Privacy Policy.

We understand that these policies are not the most thrilling of reads and that you don’t want to have to scour 7,400 pages of legal and data privacy terms to get the information that you want. So, we designed the layout and content of this policy to hopefully streamline your search and review and we promise to try to keep the language here as straightforward as possible. If you take anything away from this policy, please let it be this: we are committed to protecting not only your privacy but also your rights to control that privacy and your personal information.

What Personal Information We May Collect When You Visit Our Website and How We Collect It

When you visit our website, we may collect information (both Personal Information and non-personal information) that you voluntarily give us, for example, by filling out one of our webforms, or subscribing to our marketing communications. This information may include: your name and contact information, such as telephone number, email address, and mailing address; and professional details such as the organization you are affiliated with, your job title, and the industry you work in.

 

We may also collect certain information automatically from your device, like cookies! No, unfortunately, not those cookies. Events, Marketing and Sales Interactions

3.1

What Personal Information We May Collect Through Events, Marketing, and Sales Interactions and How We Collect It

There are many situations where we will be lucky enough to interact with you directly. These interactions may include but not be limited to in person meetings, visiting our Ping office locations, or through other various channels (outlined below).

 

During these interactions, we will collect the Personal Information that you voluntarily provide us. Examples of this information may include: your name and contact information, such as telephone number, email address, and mailing address; and professional details such as the organization you are affiliated with, your job title, and the industry you work in. Again, your decision to provide us with this information is completely voluntary.

 

If you attend one of our in-person or virtual events, or if you agree to be recorded during any telephone or video meeting (including those with our sales team), we may record some or all of that event or meeting, which may include, but not be limited to the following: recording your participation in interactive sessions, interviewing you at the event, or taking photos and video, etc.

 

Additional channels where we may collect Personal Information include (but are not limited to the following):

 

  • Completion and submission of online forms (such as registration forms for in-person or virtual events, webinars, webinar recordings, and asset downloads) as part of joint marketing activities with business partners; handing over your business card or scanning your badge at a Ping booth (virtual or in-person) at a trade show or industry event;
  • If you are a representative or employee of a business, sales inquiries that either you or we initiate;
  • Subscription to marketing communications in the Ping Identity Preference Center;
  • Completion of questionnaires and surveys; or
  • Participation in sweepstakes and contests.

Personal Information That We Automatically Collect in Connection With Events, Marketing, and Sales Interactions

We may collect information about you through various technologies like cookies, web beacons, pixels, and similar technologies when you visit our site or use our website-based services. This may include information such as your IP address, device type, unique device identification numbers, browser-type, broad geographic location and other technical information. In some jurisdictions, this information may be considered Personal Information under data protection laws.

  • Information collected by our marketing service providers on our behalf, which include a variety of marketing lead generation and content syndication service providers and/or professional event organizers;
  • Information shared with us by our business partners as part of their referral activities; or

In some situations, we may combine the business information contemplated by this provision with other non-personal and personal information we have obtained. For example, we may combine your contact information with details about your enterprise, and then analyze the information for new or additional business opportunities and/or to send you bespoke content.

  • Marketing, Events, and other Uses. We may use your Personal Information to maximize the benefits that you and/or your organization can realize by utilizing Ping’s products and services. To achieve this end, we may use your Personal Information:

    • To keep you up to date on our latest product announcements, product updates, unique offers, and other information regarding our products and services (including marketing-related information or newsletters) as well as our events and any of our partners’ offers;
    • To provide you with requested marketing products, such as registration to an event or access to webinars, newsletters or other marketing assets. We may also engage with you through other channels such as chat-functionalities or other web appearances;
    • To display relevant content on our channels and provide a personalized experience and implement any preferences you request; or
    • To record calls and chats for quality improvement purposes, to keep you up to date on marketing channels and services, and to follow-up on a referral or request your feedback.

  • Legal and Security. We may use your Personal information in responding to requests by government or law enforcement authorities conducting an investigation including in any legal claims, compliance and regulatory issues, and audit functions.

  • Who we share your personal information with in Connection with Events, Marketing, and Sales Interactions. We will not share your Personal Information with a third-party except in limited circumstances. The following list includes those circumstances:

  • Sponsors and Exhibitors for Events. You may attend our events (whether virtual or in-person) and we may share your information with our sponsors and exhibitors at those events, if allowed under applicable law. In addition, our sponsors, co-sponsors and/or exhibitors may directly request your information at their conference booths or presentations, or you may fill out a registration form or scan a badge with them. Please make sure that you review their respective privacy policies to learn how they use Personal Information.

  • Where we have obtained your consent or otherwise permitted or required by law. We may also disclose personal information to third parties on other lawful grounds, including:

ShoCard Application and SMS Messaging

This section applies if you download or purchase our ShoCard application (“ShoCard”) (independent of a relationship between Ping Identity and your employer or service provider) and/or if you utilize any SMS messaging features of our Products. If you downloaded or purchased ShoCard, we are a processor of your information and you are the controller of your data. We will only process the data that you select to provide us with in accordance with ShoCard’s functionality and its terms of use. Our provision and your use of ShoCard, and any liability associated therewith, shall be governed by the terms of use that you agree to upon download or purchase of the product or application. In the event you utilize any SMS messaging features of our Products, we will process such information as a processor or service provider on behalf of our customers, as outlined by the next paragraph, however, no Personal Information obtained by us through any SMS short code program will be shared with any third-parties for their marketing reasons/purposes.

 

A friendly reminder here, this Privacy Policy does not apply to you to the extent that we process any of your Personal Information as a processor or service provider on behalf of our customers.  Ping Identity has no direct relationship with the individual users/employees of our customers, and the type of information that is processed by our Products is at the sole discretion of our customers. We are not responsible for the privacy or data security practices of our customers, which may differ from those explained in this Privacy Policy, and we encourage you to reach out to our customer(s) directly.

4.1

What Personal Information We May Collect When You Use ShoCard and How We Collect It

The types of Personal Information that we process when you use ShoCard may include contact information (such as your first and last name, email address, and phone number), government issued identification information, professional information (such as the department you work for at your place of employment), protected health information, biometric data (such as facial recognition), or other types of information.

Basis on Which We Collect Personal Information When You Use ShoCard

Our legal basis for collecting Personal Information when you use our products will depend on the specific context in which it is collected or used. We collect Personal Information from you only where:

 

  • We have your consent to do so.
  • We need the Personal Information to perform a contract with you.
  • The processing is in our legitimate interests and not overridden by your rights.

How We Use Your Personal Information in Connection With ShoCard

  • General. We may use your Personal information to:

    • Provide you with ShoCard, which provision may include verifying your identity or to provide a credential.
    • Take and process payments.
    • Send you communications (for example, related to payments).
    • Provide service or support for ShoCard.
       
  • Legal and Security. We may use your Personal information in:

    • The detection and prevention of fraud, security or other technical issues.
    • Verifying accounts and account activity and identify violations of use restrictions of our products or our product and service policies.
    • Responding to requests by government or law enforcement authorities conducting an investigation including in any legal claims, compliance and regulatory issues, and audit functions.
       
  • With Your Consent. For any other purpose not listed where you have given us your consent to do so.

Who We Share Your Personal Information With in Connection With ShoCard

Our Recruiting and Hiring Activities

5.1

What Personal Information We May Collect During Recruiting and Hiring Activities

We are honored that you want to join the Ping family. As part of our hiring activities, we collect and maintain different types of Personal information about you in accordance with applicable law. Some examples include (but are not limited to the following):

 

  • Identification data and contact details – including your name, address, email address, phone number and other contact information, gender, date of birth, nationality/ies, national identifiers (such as national ID/passport, social security number(s)).

  • Employment history – such as previous employers and job titles/positions.

  • Background information – such as academic/professional qualifications, job qualifications, education, details included in your CV/résumé (which might include details of any memberships or interests constituting sensitive personal information), transcripts and employment references.

  • Details of your nominated referees (including their name, contact details, employer and job role).

  • Details of your immigration/visa status.

  • Previous applications/roles (information relating to previous applications you have made to the Company's Group and/or any previous employment history with the Company's Group).

  • Bank account details you provide in accordance with our candidate reimbursement policy.

  • Other information you voluntarily provide throughout the process, including through assessments, exercises, and interviews.

 

As a general rule, during the recruitment process, we try not to collect or process any of the following: information that reveals your racial or ethnic origin, religious, political or philosophical beliefs or trade union membership; genetic data; biometric data for the purposes of unique identification; or information concerning your health/sex life ("Sensitive Personal Information"), unless authorised by law or where necessary to comply with applicable laws.

 

However, in some circumstances, we may need to collect, or request on a voluntary disclosure basis, some Sensitive Personal Information for legitimate recruitment-related purposes: for example, information about your racial/ethnic origin, gender and disabilities for the purposes of equal opportunities monitoring, to comply with anti-discrimination laws and for government reporting obligations; or information about your physical or mental condition to consider accommodations for the recruitment process and/or subsequent job role.

5.2

How We Collect Personal Information During Recruiting and Hiring Activities

Generally, we collect employee-related Personal Information directly from you in circumstances where you provide us with such information (e.g., during the onboarding process, signing up for direct deposit, enrolling in benefits or services). However, in some instances, we supplement your Personal Information with other information that we obtain through your interactions with us or from third parties. When we collect your Personal Information from third parties it is either because you have given us express permission to do so, your permission was implied by your actions (e.g., your use of a third-party employee service made available to you by us), or because you provided explicit or implicit permission to the third party to provide the Personal Information to us.

 

Some examples of Personal Information collected from other sources include (in each case, where permissible and in accordance with applicable law):

 

References provided by referees;

 

  • Other background information provided or confirmed by academic institutions and training or certification providers;
  • Criminal records data obtained through criminal records checks;
  • Information provided by background checking agencies and other external database holders (for example credit reference agencies and professional / other sanctions registries);
  • Information provided by recruitment or executive search agencies; or
  • Information collected from publicly available sources, including any social media platforms you use or other information available online.

Basis on Which We Collect Personal Information as Part of the Recruiting and Hiring Process

Our legal basis for collecting Personal Information as part of the hiring and recruitment process will depend on the specific context in which it is collected or used. We collect Personal Information from you only:

 

  • Where our legitimate interests are not overridden by your data protection interests or fundamental rights and freedoms;
  • To comply with applicable immigration and/or employment laws and regulations;
  • To take steps prior to entering an employment contract with you, where you are considered for employment;
  • In circumstances where you have made the data public;
  • Where we have your consent to do so; or
  • To protect the rights and interests of the Company's Group, our employees, applicants and others, as required and permitted by applicable law.

Purposes of Using Your Personal Information in Our Recruiting and Hiring Activities

We collect and use this personal information primarily for recruitment purposes – in particular, to determine your qualifications for employment and to reach a hiring decision. This includes assessing your skills, qualifications and background for a particular role, verifying your information, carrying our reference checks or background checks (where applicable) and to generally manage the hiring process and communicate with you about it. 

 

If you are accepted for a role at Ping, the information collected during the recruitment process will form part of your ongoing staff member record and will be processed in accordance with our Global Data Privacy Notice for Staff.

 

If you are not successful, we may still keep your application to allow us to consider you for other suitable openings within Ping in the future unless you request that we delete your application. 

 

We may also use your Personal information in responding to requests by government or law enforcement authorities conducting an investigation including in any legal claims, compliance and regulatory issues, and audit functions.

International Data Transfers

We are headquartered in the United States, and as such, your Personal Information will be stored, transferred to, processed, or accessed within the United States, regardless of your country of residence. Ping Identity complies with both the EU-US and Swiss-US Privacy Shield programs operated by the U.S. Department of Commerce. These programs provide standards for the collection, use, and retention of personal data transferred from the European Union, and Switzerland to the United States. We also adhere to the Privacy Shield Principles for personal data transferred from the United Kingdom to the U.S.

Data Retention

Personal information will be stored in accordance with applicable laws and kept as long as needed to carry out the purposes described in this Privacy Policy or as otherwise required by applicable law. Generally, this means your Personal Information will be retained where we have an ongoing legitimate business need to do so (e.g., to provide you with a service you have requested or to comply with applicable legal, tax or accounting requirements). When we have no ongoing legitimate business need to process your Personal Information, we will either delete or anonymize it, or, if this is not possible (e.g., because your Personal Information has been stored in backup archives), then we will securely store your Personal Information and isolate it from any further processing until deletion is possible.

Security

We have implemented appropriate technical and organizational measures to protect the Personal Information we have under our control from unauthorized access, improper use or disclosure, unauthorized modification, and unlawful destruction or accidental loss. Although we follow industry standards to protect Personal Information, no method of storage or transmission is 100% secure. You are solely responsible for protecting your passwords, limiting access to your devices, and signing out of websites after your sessions. Our websites and activities are not directed at children. We do not knowingly collect, use, or sell Personal Information from children under the age of 16.

EEA/UK Rights

This section is for people who are located in the European Economic Area (“EEA”) or United Kingdom (“UK”) and supplements our general Privacy Policy and Cookie Policy. The term “Personal Information” is referred to as “Personal Data” in the EEA/UK, so the terminology has been adjusted in this section to reflect this.

 

We are considered the controller of your personal information, unless otherwise specified herein. This Privacy Policy does not apply to the extent we process Personal Information in the role of a processor or service provider on behalf of our customers, including where we offer to our customers various cloud products and services (with a limited exception explained in our Products tab).

 

In the EEA or UK, you may have a number of special privacy rights.  These rights may include the following:

 

  • The right to access, correct, update or request deletion of your Personal Information.
  • The right to object to processing of your Personal Information, ask us to restrict processing of your Personal Information or request portability of your Personal Information.
  • If we have collected and process your Personal Information with your consent, then you can withdraw your consent at any time.  Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Information conducted in reliance on lawful processing grounds other than consent.

If you believe your Personal Data is being processed by our Products on behalf of our customers (who may be your employer or service provider, for example) and you would like to exercise your rights under applicable data protection laws, please direct your query to your employer or service provider, as appropriate.

 

In some cases, the sharing described above may result in your personal information being transferred internationally, including from the EEA or UK to a country outside it. These countries may have data protection laws that are different to the laws of your country (and, in some cases, may not be as protective). We have implemented the European Commission’s Standard Contractual Clauses (under Article 46.2 of the General Data Protection Regulation) between our group companies and other third parties (where applicable). We require our group companies and third parties to protect the Personal Information of citizens in the EEA and UK in accordance with the data protection laws of the EEA and UK. Specifically, our group companies, affiliated companies and third party service providers operate around the world.  This means that when we collect your personal information we may process it in any of these countries.
